Welcome to SoCajun SweetZ. By accessing this website, placing an order, submitting a custom order request, or purchasing any products from SoCajun SweetZ, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions. If you do not agree to these Terms, please do not use this website or purchase our products.

1. About Our Bakery

SoCajun SweetZ is a home-based bakery operating in the State of Texas under the Texas Cottage Food Law. All products are handcrafted and made fresh to order.

2. Orders

Orders are accepted based on product availability.

Our Weekly Menu contains limited quantities and products may sell out without notice.

Custom orders are accepted based on availability and require advance notice.

Submitting an inquiry does not guarantee acceptance of an order.

An order is not confirmed until payment has been successfully received.

3. Payment

Full payment is required before production begins.

We reserve the right to refuse, cancel, or decline any order prior to production.

Orders will not be prepared until payment has been successfully processed.

4. Pricing

Prices are subject to change without prior notice.

Rush order fees, delivery charges, taxes (if applicable), and special customization fees may apply.

5. Pickup & Delivery

Pickup is by appointment only.

Customers are responsible for arriving during their scheduled pickup window.

Orders not collected within one hour of the scheduled pickup time may require rescheduling or additional delivery fees.

Local delivery is offered only within our designated service area.

Delivery times are estimates and may be affected by weather, traffic, or other unforeseen circumstances.

Risk of loss transfers to the customer once an order has been delivered or picked up.

6. Weekly Menu & Availability

Our Weekly Menu changes regularly.

Availability is limited and products are sold while supplies last.

Seasonal menu items may be introduced throughout the year without notice.

7. Custom Orders

Custom orders require advance notice.

Acceptance of custom orders is at the sole discretion of SoCajun SweetZ.

Flavor substitutions outside of our published menu are not available unless specifically approved.

8. Cancellations

Orders may be canceled up to five (5) days before the scheduled pickup or delivery date.

Orders canceled with fewer than five days' notice are not eligible for a refund because ingredients, production time, and scheduling have already been reserved.

9. Refund Policy

Due to the perishable nature of our products, all sales are final.

Refunds, replacements, or store credits may be offered solely at the discretion of SoCajun SweetZ if an error occurred in fulfilling the order.

10. Allergy Disclaimer

Our products are prepared in a home kitchen that handles:

  • Wheat

  • Milk

  • Eggs

  • Soy

  • Peanuts

  • Pecans

  • Walnuts

  • Tree Nuts

Although reasonable care is taken during preparation, cross-contact with allergens cannot be prevented or guaranteed.

Customers with food allergies or dietary sensitivities assume full responsibility for determining whether our products are suitable for consumption.

By purchasing from SoCajun SweetZ, you acknowledge this risk and agree that SoCajun SweetZ shall not be responsible for allergic reactions or adverse health effects resulting from the consumption of our products, except where liability cannot legally be excluded under applicable law.

11. Product Appearance

Each dessert is handcrafted.

Colors, decorations, frosting, drizzle patterns, and other design elements may vary slightly from website photographs.

Photographs are intended as representative examples only.

12. Food Safety & Storage

Customers are responsible for properly storing desserts after pickup or delivery.

Failure to refrigerate products requiring refrigeration or improper storage may affect quality and food safety.

SoCajun SweetZ is not responsible for product quality once an order has been picked up or successfully delivered.

13. Limitation of Liability

To the fullest extent permitted by applicable Texas law, SoCajun SweetZ's liability for any claim arising out of or relating to the purchase or consumption of our products shall be limited to the amount paid for the applicable order.

SoCajun SweetZ shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use or consumption of our products, except where such limitations are prohibited by law.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law, including liability arising from fraud, willful misconduct, or gross negligence.

14. Customer Responsibility

Customers are responsible for:

  • Reviewing ingredient information

  • Providing accurate order details

  • Providing accurate pickup and delivery information

  • Informing us of any dietary concerns before ordering

15. Intellectual Property

All photographs, logos, branding, recipes (to the extent protected), graphics, text, website design, and other content are the exclusive property of SoCajun SweetZ and may not be copied, reproduced, or used without written permission.

16. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas.

Any dispute relating to these Terms shall be governed by applicable Texas law.

17. Force Majeure

SoCajun SweetZ shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms & Conditions when such delay or failure results from causes beyond our reasonable control. Such events may include, but are not limited to:

  • Hurricanes, tornadoes, floods, or other severe weather events;

  • Fires, explosions, or other natural disasters;

  • Power outages, internet or utility failures;

  • Public health emergencies, epidemics, or pandemics;

  • Government actions, emergency orders, or changes in applicable law;

  • Transportation disruptions or supply chain shortages;

  • Labor shortages or strikes affecting suppliers or carriers;

  • Acts of terrorism, civil unrest, or other emergencies; or

  • Illness, injury, or other unforeseen circumstances that prevent safe food preparation or fulfillment.

If a Force Majeure event occurs, SoCajun SweetZ may, at its sole discretion, delay, reschedule, modify, or cancel an affected order. If an order cannot reasonably be fulfilled due to a Force Majeure event, customers will be offered either a rescheduled fulfillment date or, where appropriate and at SoCajun SweetZ's discretion, a refund or store credit for any portion of the order that cannot be completed.

SoCajun SweetZ shall resume normal operations as soon as reasonably practicable once the Force Majeure event has ended.

18. Changes to These Terms

SoCajun SweetZ reserves the right to modify these Terms & Conditions at any time.

Updated versions become effective immediately upon publication on this website.

Continued use of this website or placing an order constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms & Conditions is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid or unenforceable provision shall be interpreted or modified only to the extent necessary to make it enforceable while preserving its original intent to the fullest extent permitted by law.

20. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Frequently Asked Questions, Refund Policy, Pickup & Delivery Policy, and any other policies published on the SoCajun SweetZ website, constitute the entire agreement between SoCajun SweetZ and the customer regarding the purchase of products and use of this website and supersede all prior communications, understandings, or agreements relating to such matters.

21. Electronic Acceptance

By accessing this website, submitting an order, completing checkout, clicking any button indicating acceptance of these Terms & Conditions (where applicable), or otherwise purchasing products from SoCajun SweetZ, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions, our Privacy Policy, and all other applicable policies published on this website.

Electronic acceptance of these Terms & Conditions shall have the same legal effect as a handwritten signature to the fullest extent permitted by applicable law.

22. No Waiver

The failure of SoCajun SweetZ to enforce any provision of these Terms & Conditions, or to exercise any right or remedy available under these Terms & Conditions, shall not constitute a waiver of that provision, right, or remedy. Any waiver shall be effective only if made in writing and signed by an authorized representative of SoCajun SweetZ.

23. Right to Refuse Service

SoCajun SweetZ reserves the right to refuse, decline, cancel, or limit any order or service request at its sole discretion, to the extent permitted by applicable law. This includes, but is not limited to, situations involving:

  • Fraudulent or suspected fraudulent activity;

  • Chargebacks or payment disputes;

  • Abusive, threatening, harassing, discriminatory, or inappropriate behavior toward SoCajun SweetZ or its representatives;

  • False or misleading order information;

  • Product unavailability or inventory limitations;

  • Pricing or typographical errors;

  • Requests that cannot be safely or reasonably fulfilled;

  • Violations of these Terms & Conditions; or

  • Any circumstance in which fulfilling the order would present an unreasonable business, legal, or safety risk.

If an order is canceled by SoCajun SweetZ before production begins, any eligible payment received will be refunded in accordance with our Refund Policy.

24. Accuracy of Website Information

We strive to ensure that all information on our website, including product descriptions, pricing, availability, photographs, promotions, and policies, is accurate and up to date. However, errors, omissions, or inaccuracies may occasionally occur.

SoCajun SweetZ reserves the right to correct any errors, update information, modify product offerings, or cancel orders affected by such errors without prior notice. If an order is canceled due to a pricing or website error before production begins, any eligible payment received will be refunded.

25. Product Representation

Every dessert is handcrafted and made to order. As a result, the appearance of each product may vary slightly from website photographs or promotional images.

Variations in color, icing, glaze, drizzle, decorations, texture, shape, or other aesthetic details are normal and do not constitute a defect. Product photographs are intended to represent the overall style and quality of our desserts and should not be interpreted as exact replicas.

26. Customer Responsibilities

Customers are responsible for:

  • Providing accurate contact, billing, pickup, and delivery information;

  • Reviewing all order details before submitting an order;

  • Informing SoCajun SweetZ of any allergies or dietary concerns prior to purchasing;

  • Ensuring someone is available to receive delivery, when applicable;

  • Following all recommended storage and handling instructions after pickup or delivery.

SoCajun SweetZ is not responsible for delays, additional charges, spoiled products, or other issues resulting from inaccurate information provided by the customer or from the customer's failure to follow storage or handling recommendations.

27. Third-Party Payment Processors

Payments made through this website are processed by secure third-party payment providers. SoCajun SweetZ does not store or have access to your complete credit or debit card information.

By completing a purchase, you also agree to the applicable terms and privacy policies of the third-party payment processor used to complete your transaction.

28. Website Availability

While we strive to maintain continuous access to our website, we do not guarantee uninterrupted availability. Access may occasionally be interrupted due to maintenance, technical issues, internet outages, security concerns, or circumstances beyond our reasonable control.

SoCajun SweetZ shall not be liable for any loss or inconvenience resulting from temporary website unavailability.

29. Communications

By placing an order or submitting information through our website, you consent to receive communications from SoCajun SweetZ regarding your order, including confirmations, receipts, pickup instructions, delivery updates, customer service communications, and important policy or website updates.

30. Promotions & Discounts

Promotional offers, discounts, coupon codes, giveaways, and special pricing are subject to change or cancellation at any time without prior notice.

Unless expressly stated otherwise, promotional offers may not be combined with any other discounts or promotions and have no cash value.

31. Photography & Marketing

Unless otherwise requested by the customer in writing before order fulfillment, SoCajun SweetZ reserves the right to photograph completed desserts for use in marketing materials, social media, advertising, and portfolio displays.

Customer names, contact information, payment information, and other personal identifying information will never be shared without permission.

32. Texas Cottage Food Disclosure

SoCajun SweetZ operates as a home-based cottage food business in accordance with applicable Texas law.

Products are prepared in a home kitchen that is not routinely inspected by the Texas Department of State Health Services or a local health department, except as otherwise permitted or required by law.

By purchasing from SoCajun SweetZ, customers acknowledge that they understand the nature of a Texas cottage food operation.
